The renewal of the acquisition of places for tourist stays in accommodation located in the Balearic Islands (ETVPL, ETVPL60 and ETV60)

On 23rd February 2023 the Mallorca Island Council made public the procedure to be followed for the renewal of all those tourist places acquired for a period of 5 years.

The renewal of these places will therefore not be affected by the freezing of the stock exchange (moratorium) decreed by the Balearic Government.

This is the case of places destined for tourist stays in multi-family residential properties or properties subject to the horizontal property regime (ETVPL) as well as the case of places destined for tourist stays in single-family or multi-family properties, which constitute the owner's usual or main residence and which are covered by this modality (ETV60 or ETVPL60).

For the purposes of calculating the aforementioned 5-year period, the date of registration of the property in the tourist register or, in other words, the date on which the DRIAT was registered, should be taken into account.

It is essential to be clear about this date as well as the date on which the deadline expires, as the Tourism Law itself clearly establishes that, if the renewal or extension application is not submitted BEFORE THE DEADLINE EXPIRES, the definitive deregistration is automatic once five years have elapsed since the DRIAT was submitted.

Thus, the procedure for the renewal of the places must be initiated at the request of a party and always before the end of the aforementioned period.

As for the required documentation, it will be necessary to obtain an updated municipal certificate certifying that the area where the property is located is still classified as suitable. The property must also have a valid occupancy certificate..

In addition, in the case of deferred payment or payment in instalments, it will be necessary to provide a certificate of ownership of the bank account and of the direct debit.

The price of the places remains at €875.- per place for multi-family properties or properties subject to horizontal property and €291.67.- per place for properties subject to the habitual residence modality. The payment, as until now, can be made in a single payment, or pro rata in five annual payments.
