Holiday rentals: final zoning proposal in Mallorca, excluding Palma

Following the provisional delimitation (zoning) of the areas suitable to market holiday rentals in private property in Mallorca, which had been published in January 2018, a FINAL PROPOSAL has now been published by the Department of Territories and Infrastructure of the Council of Mallorca. The final proposal was adopted after the initial period of public exposure which generated 26 reports, 43 claims, objections, meetings …

The proposal has now been passed to the Balearic Environmental Committee which has one month to submit a report, which will be binding. The final document has to be adopted in the plenary session of the Counsel of Mallorca before July 31, 2018. Otherwise the new DRIATS can be submitted from 2 August 2018, and the licenses could be purchased, except for multi-family homes.


Until the zones have been officially approved, one must remember that the only properties that can be advertise as holiday rentals are the ones that have obtained a license or have requested one before 1st of August 2017. Also, the moratorium will expire in 2 months.

 

MALLORCA has been divided into 7 areas:

 

 

LICENSES

There are two types of holiday rental licenses in Mallorca, which have the following characteristics:

 

This type of license can only be granted if the owner has his/her habitual residence in the property s/he intends to let.

 

In some cases, there may be a distinction between single-family homes and multi-family houses. However, this license can also be granted if the owner does not have his/her habitual residence in the property s/he intends to let.

 

PROPERTY TYPES

There may be a distinction between the letting of single-family homes and multiple-family houses (such as apartment buildings). In some areas (zones) only the rental of single-family homes will be permitted. Also, the letting of flats (multi-family houses) always requires the permission of the building´s community association.

 

 

ZONING

 

ZONE 1: VULNERABLE COASTAL TOURIST AREAS WITH INCREASED TOURISM

PALMANOVA, MAGALUF, SANTA PONÇA, PAGUERA, BELLAVISTA, CALA BLAVA Y SON VERI NOU.

 

** EL ARENAL DE LLUCMAJOR ONLY PERMITS HOLIDAY RENTALS IN SINGLE-FAMILY HOMES.

 

60 Days

The rental of single-family homes and flats located in this area will only be granted for max. 60 days/year. The proprietor who wishes to let his/her home for holiday rentals must have his/her habitual residence in the property which s/he intends to rent out. Holiday rentals in multi-family houses always require the permission of the building´s community association.

 

 

ZONE 2: REMAINING COASTAL TOURIST AREAS:

This area is defined through exclusion of the previous zone and includes, for instance: Sant Elm, Costa d´en Blanes, Portals Nous, Illetas, Cala Vinyes, Puerto de Andratx, CAMP DE MAR, EL TORO, COSTA DE LA CALMA, Portals Vells, SA TORRE, BAHÍA GRANDE, EL DORADO, Bahía Azul, Cala Pi, VALLGORNERA, S´ESTANYOL, SES COVETES, La Rápita, Colonia de Sant Jordi, Cala Santanyí, Cala Llombards, CALA FIGUERA, CALA MONDRAGÓ, Portopetro, Cala d´Or, CALA FERRERA, CALA MARÇAL, PORTOCOLOM, CALA MURADA, ES DOMINGOS, Calas de Mallorca, S´ESTANY D´ES MAS, CALA MENDIA, CALA ANGUILA, S´ILLOT, Porto Cristo, Sa Coma, Cala Millor, Cala Bona, PORT VELL, Costa dels Pins, CANYAMEL, FONT DE SA CALA, Cala Ratjada, Cala Mesquida, Betlem, Colonia de Sant Pere, Son Serra de Marina, Can Picafort, Puerto de Alcudia, Puerto de Pollensa, BONAIRE, ES BARCARÉS, Formentor, Cala Sant Vicenç… 

 

** HOLIDAY RENTALS IN PLAYA DE MURO, WHICH USED TO BE PART OF THIS ZONE, WILL BE PROHIBITED IN MULTI-FAMILY HOUSES.

 

** PUERTO DE SOLLER STILL BELONGS TO THIS ZONE BUT IT MUST BE EMPHISIZED THAT HOLIDAY RENTALS IN THE HISTORIC CENTRE WIILL ONLY BE PERMITTED FOR 60 DAY AND WITH HABITUAL RESIDENCE IN THE PROPERTY BEING LET. 

 

60 Days

Proprietors of real estate in this area can apply for a license which will allow them to rent out their single-family home or flat for holiday purposes for a max. duration of 60 days/year. The person applying for this license must have his/her habitual residence in the property which s/he intends to rent out. Holiday rentals in multi-family houses always require the permission of the building´s community association.

 

365 Days

Alternatively, a proprietor interested in holiday rentals can apply for a license which grants permission to rent out his/her property for up to 365 days/year. Holiday rentals in multi-family houses always require the permission of the building´s community association.

 

 

ZONE 3: VULNERABLE INNER-CITY AREAS WITH INCREASED TOURISM 

ALCUDIA, BANYALBUFAR, PORT DES CANONGE, ORIENT, ULLARÓ, DEIÁ, LLUCALCARI, SA CALA, S´EMPELTADA, ESTELLENCS, FORNALUTX, MARRATXINET, POLLENÇA, ES VILÁ, LA FONT, SANTANYÍ, SES SALINES, SOLLER, BINIARAIX, L´HORTA, VALLDEMOSA, ES PORT DE VALLDEMOSA, S´ARXIDUC y SON FERRANDELL.

 

60 Days

The rental of single-family homes and flats located in this area will only be granted for max. 60 days/year. ZONE 4: REMAINING INNER-CITY AREAS

This area is defined through exclusion of the previous zone and includes, for instance: FELANITX, LLUCMAJOR, S´ARRACÓ, ANDRATX, CAPDELLÁ, CALVIÁ, GALILEA, SON SERRALTA,  PUIGPUNYENT, ESPORLES, BUNYOLA, PALMANYOLA, SA COMA, SANTA MARÍA, SA CABANA, PONT D´INCA, PLA DE NA TESA, PORTOL, CONSELL, BINISSALEM, BINIAMAR, LLOSETA, MANCOR, SELVA, INCA, CAIMARI, SA POBLA, ALARÓ, LLUC, BÚGER, SENCELLES, SANTA EUGENIA, COSTITX, LLORET, PINA, ALGAIDA, MONTUIRI, MANACOR, SANT LLORENÇ, SON SERVERA, ARTÀ, CAPDEPERA, SANTA MARGALIDA, PETRA, VILAFRANCA, SANT JOAN….

 

** THE FOLLOWING AREAS HAVE BEEN MOVED FROM ZONE 3 TO ZONE 4: S´ESGLEIETA, RUBERTS, ES CARRITXÓ, SES COVES, ARIANY, ES LLOMBARDS Y RANDA: HOLIDAY RENTALS ARE PERMITTED 365 DAYS/YEAR IN SINGLE-FAMILY HOMES AND IN MULTI-FAMILY HOUSES.

 

** IN MARRATXI, HOLIDAY RENTALS OF FLATS ARE ONLY PERMITTED FOR 60 DAYS. HOLIDAY RENTALS OF SINGLE-FAMILY HOMES ARE PERMITTED FOR 365 DAYS.

 

** IN MURO HOLIDAY RENTALS ARE ONLY PERMITTED IN SINGLE-FAMILY HOMES.

 

60 Days

Proprietors of real estate in this area can apply for a license which will permit holiday rentals of their single-family home or flat for a max. duration of 60 days/year. The person applying for this license must have his/her habitual residence in the property which s/he intends to rent out. Holiday rentals in multi-family houses always require the permission of the building´s community association.

 

365 Days

Alternatively, a proprietor interested in holiday rentals can apply for a license which grants permission to rent out his/her property for up to 365 days/year. Holiday rentals in multi-family houses always require the permission of the building´s community association.

 

 

 

ZONE 5: PROTECTED RURAL LAND

This area consists of Protected Areas of Special Natural Interest which require a High Level of Protection (AANP), Protected Areas of Special Natural Interest (ANEI), Rural areas of Scenic Interest (ARIP), the Areas of Risk Prevention (APR) and the Protected Territorial Areas (APT)

In these areas HOLIDAY RENTALS are PROHIBITTED under the Balearic Tourism Law.

 

 

ZONE 6: COMMON RURAL LAND

This area is defined through exclusion of the previous zone.

 

60 Days

Proprietors of real estate in this area can apply for a license which will permit holiday rentals of their single-family home or flat for a max. duration of 60 days/year. The person applying for this license must have his/her habitual residence in the property which s/he intends to rent out. Holiday rentals in multi-family houses always require the permission of the building´s community association.

 

365 Days for single-family homes only

Alternatively, a proprietor interested in holiday rentals can apply for a license which grants permission to rent out his/her single-family home for up to 365 days/year.

 

 

ZONE 7: EXCLUDED AREAS (GREY)

Industrial areas and an area of airport easement next to the airport of SON SANT JOAN.

 

** SES CASETES DES CAPELLANS has been added to this zone. holiday rentals of any type are prohibited in this area.

 

 

Note:     With regards to zones 1, 2, 3, 4 and 6, it is currently unknown whether applicants of the 60-day license would have to let their property over a continuous period or if the 60 days can be applied throughout the entire fiscal year.
