Informative note on the obligation to keep a cleaning service register-book

With the entry into force of Law 3/2022 on Circularity, an important novelty has been introduced in the Tourism Law that directly affects holiday homes.

From 1 May 2023, marketers of tourist stays in residential dwellings will have to keep a log book, in which the date and identification of the person or company that carries out the activities of cleaning the dwelling, changing bed linen and towels as well as garden/pool maintenance will be recorded.

This register book shall adopt the model determined by the island's tourism administration, which may be electronic, provided that its veracity is guaranteed for the purposes of data verification, or in paper format.

The Consell Insular de Mallorca has published the model of the register book to be used, which is available on its website, at the following link:

This is a simple cover sheet to be filled in by the owner/operator, accompanied by a series of sheets to be filled in after each cleaning carried out in the dwelling, either by the person or cleaning company contracted, or by the owner himself if he is the one who undertakes the cleaning work.

The regulation stipulates that, in the event of requesting the renewal of the book, the trader shall present the previous book to justify the completion of its pages or its deterioration, although the currently published model does not require the legalisation of books by the Consell.  

When the first book is finished, it will be kept and a new one will be printed, and it must be placed in the dwelling for the purpose of any possible inspection. The register book shall be kept up to date during the periods of the tourist stay and shall be available to the inspectors of the island's tourist administration.

In the event of loss or destruction of the book or any other similar circumstance, this shall be justified by means of a written declaration by the person marketing tourist stays in dwellings for residential use, including the non-presentation and the evidence available to him/her, and this circumstance shall be stated in the authorisation procedure.
